Ontario CPA 2002 ā€” Internet Agreements:Ā Under ss.37-56 of the Consumer Protection Act, 2002, online sales to Ontario consumers require specific pre-purchase disclosures. If these are not clearly provided, consumers may cancel within 7 days and are entitled to a full refund within 15 days. This Terms & Conditions page fulfils that mandatory disclosure requirement.

These Terms & Conditions of Sale ("Terms") govern all purchases made through the babywarehouse.ca website and apply to all online orders placed with Baby & Kids Furniture Warehouse ("B&K," "we," "us"). By placing an order on our website, you agree to these Terms. In-store purchases are governed by our in-store sales policies.

1. About Us

Baby & Kids Furniture Warehouse is an Ontario-based specialty retailer of nursery furniture, cribs, mattresses, bedding, gliders, and children's bedroom furniture. We operate our Toronto showroom and offer Canada-wide shipping.

Product descriptions

We make every effort to accurately describe and photograph our products. Colours may vary slightly between your screen and the actual product due to display settings. If you have questions about a specific product, contact us before purchasing.

Canada Consumer Product Safety Act (CCPSA) Compliance

All cribs, bassinets, cradles, mattresses, and crib bedding sold by Baby & Kids Furniture Warehouse are sourced from manufacturers and distributors who comply with the Canada Consumer Product Safety Act (CCPSA) and applicable Health Canada product regulations, including:

  • Cribs, Cradles and Bassinets Regulations (SOR/2016-152)
  • Mattresses Regulations (SOR/2016-183)
  • Playpens Regulations (SOR/2016-180)

If you become aware of a product safety concern after your purchase, contact Health Canada at 1-866-662-0666 or hc-sc.gc.ca, and notify us immediately.

Safe Sleep Notice

Health Canada Safe Sleep Guideline:Ā Health Canada recommends that infants under 12 months sleep on a firm, flat surface in a crib, cradle, or bassinet that meets current Canadian safety standards. No pillows, comforters, bumper pads, or loose bedding should be placed in the sleep space with a baby. Please review Health Canada's safe sleep guidelines at canada.ca before setting up your nursery.

3. Pricing & Payment

Prices

All prices on babywarehouse.ca are displayed in Canadian dollars (CAD) and include applicable taxes where indicated. We reserve the right to correct pricing errors. If an item is listed at an incorrect price due to a typographical error, we reserve the right to cancel the order and refund any payment received.

Accepted payment methods

Full payment must be made prior to delivery or pick-up of your order.

We do not ship on account.

Price changes

Prices are subject to change without notice. The price at the time of your confirmed order is the price you pay. Promotional pricing applies only during the stated promotional period.

4. Online Order Process

Required Disclosure ā€” Ontario Consumer Protection Act, 2002:Ā Under ss.37-56 of the CPA 2002, we are required to provide you with specific information before you are bound by an internet purchase agreement. The information below fulfils that statutory requirement.

Before your order is confirmed, our website will display:

  • A clear description of each product in your order
  • The itemized price of each product, including all applicable taxes and shipping fees
  • The total amount to be charged before you confirm the purchase
  • Our contact information for post-purchase support
  • An express opportunity for you to confirm or cancel your order before payment is processed

By clicking "Confirm Order" or equivalent, you enter into a binding purchase agreement with Baby & Kids Furniture Warehouse. Once your order is confirmed, you will receive an email acknowledgment within one (1) business day.

Order processing

  • Order cut-off time:Ā Orders placed before 3:00 PM EST on a business day are processed the same day
  • Processing and shipping:Ā Orders are processed and shipped within 3ā€“5 business days if all items are in stock
  • Fulfilment days:Ā Orders are fulfilled Monday to Friday only

5. Your Right to Cancel ā€” Online Orders

Ontario CPA 2002 ā€” Statutory Cancellation Right:Ā Under the Consumer Protection Act, 2002, you have the right to cancel an internet agreement within 7 days of receiving a copy of the agreement or within 7 days of the delivery of the goods, if all required disclosures were not provided at the time of purchase. This is a statutory right and cannot be waived.

Standard 7-day cancellation window

If you have placed an order online and have NOT yet received the goods, you may cancel the order within 7 calendar days of placing it without penalty, provided:

  • The goods have not yet been shipped or delivered
  • The item is not a Special Order (see Section 7)
  • The item is not listed as Final Sale

To cancel, contact us at Info@babywarehouse.ca or call 416-288-9167. If you have already been charged, we will issue a full refund within 15 days of receiving your cancellation notice.

Extended cancellation right

If we failed to provide all required disclosures before your purchase (as listed in Section 4), your right to cancel extends to 7 days after we remediate the failure, with a maximum extended period of 1 year from the date of the agreement.

6. Delivery & Shipping

We offer Canada-wide shipping on most products. See ourĀ Shipping PolicyĀ for complete details on carriers, delivery timeframes, packaging, and claims for damaged goods.

  • Delivery timeframes are estimates and are not guaranteed
  • Shipping fees are calculated at checkout based on your location and order weight/size
  • All shipping fees are non-refundable once an order has been dispatched
  • Large furniture items (nursery sets, cribs, dressers) are delivered by freight carrier and require a signature upon receipt
  • It is your responsibility to inspect all items at the time of delivery and to note any damage on the carrier's delivery receipt

7. Special Orders

Special order items are products that are not held in our regular inventory and must be ordered specifically from the manufacturer or distributor on your behalf.

  • All special orders are final sale and cannot be cancelled once the order has been placed and payment received
  • You will be informed of the estimated lead time before completing a special order
  • Delivery estimates for special orders are based on supplier information and are not guaranteed ā€” B&K is not responsible for supplier delays or backorders
  • Once a special order arrives, you will be contacted by telephone or email to arrange delivery or pick-up

8. Warranties & Product Safety

Manufacturer warranties

Most products sold by Baby & Kids Furniture Warehouse are covered by manufacturer warranties. The specific warranty terms vary by product and manufacturer. Warranty documentation is included with your product or available on request. B&K acts as the authorised retailer for warranty service inquiries on all brands we carry ā€” please contact us first before contacting the manufacturer directly.

Statutory implied warranty ā€” Sale of Goods Act

Under Ontario's Sale of Goods Act, RSO 1990, goods sold must be of merchantable quality and fit for their ordinary purpose. This statutory implied warranty is in addition to any manufacturer's warranty and cannot be waived by B&K.

Warranty claims process

  • Contact Info@babywarehouse.ca or call 416-288-9167 with your order number and a description of the issue
  • It is entirely the customer's responsibility to bring back the purchased item under warranty which needs to be repaired or replaced
  • Baby & Kids Furniture Warehouse will not be held responsible in any way for any costs incurred in getting the product back to the store

9. Limitation of Liability

To the fullest extent permitted by Ontario law, Baby & Kids Furniture Warehouse's total liability for any claim arising from a purchase shall not exceed the amount you paid for the specific product giving rise to the claim. We are not liable for indirect, consequential, or incidental damages arising from your use of our products, except where such liability cannot be excluded under the Ontario Consumer Protection Act, 2002 or the Sale of Goods Act.

Nothing in these Terms limits our liability for death or personal injury caused by a defective product regulated under the Canada Consumer Product Safety Act.

10. Intellectual Property

All content on babywarehouse.ca ā€” including product descriptions, photographs, logos, and design elements ā€” is the property of Baby & Kids Furniture Warehouse or our licensed suppliers and is protected by the Canadian Copyright Act. You may not reproduce, republish, or commercially use our content without our prior written consent.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada. Any disputes shall be resolved in the courts of Ontario.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted. For purchases made before an update, the Terms in effect at the time of purchase apply. We encourage you to review these Terms before each purchase.
